Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by Nexibrain Technologies, including mobile development, website development, ASO, and SEO, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Nexibrain Technologies provides various digital services including but not limited to mobile application development, website design and development, App Store Optimization, and Search Engine Optimization. The specifics of these services will be detailed in individual service agreements or project scopes.

3. Intellectual Property Rights

All deliverables, designs, code, and documentation created by Nexibrain Technologies as part of our services are the intellectual property of Nexibrain until payment is received in full, at which point ownership is transferred to the client, except where otherwise agreed in writing.

4. User Obligations

You agree to provide true, accurate, and complete information as necessary for Nexibrain Technologies to perform the services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5. Payment Terms

Payment terms will be specified in individual contracts or agreements. Nexibrain Technologies reserves the right to suspend services for late or non-payment.

6. Subscriptions and In-App Purchases

Some of our apps offer optional auto-renewable subscriptions (for example Aura Premium: 19.99 € per year with a 3-day free trial, or 2.99 € per month — prices may vary by country and are always shown in the app before purchase).

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase, or at the end of the free trial if you have not cancelled at least 24 hours before it ends.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

7. Limitation of Liability

Nexibrain Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles.

8. Termination of Service

Either party may terminate the service agreement with written notice. Terms regarding termination and any associated fees will be outlined in individual service agreements.

9. Dispute Resolution

Any disputes arising from these Terms of Service will be resolved through arbitration in accordance with the laws of Vietnam.

10. Amendments to Terms of Service

Nexibrain Technologies reserves the right to modify these terms at any time. Your continued use of our services after any such changes constitutes your acceptance of the new terms.
